La Constitución de Alabama aún establece en su sección 256 que:

“La legislatura establecerá (…) un sistema de escuelas públicas a lo largo de todo el estado para el beneficio de los niños de entre 7 y 21 años de edad (…). Escuelas separadas serán provistas para niños blancos y de color, y a ningún niño de cualquier raza le será permitido atender una escuela de la otra raza”.

Este artículo se intentó modificar en 2004 y en 2012, pero la propuesta fue rechazada por temor a que ello implicara un aumento del financiamiento de la educación.
